1. Acceptance of Terms

By accessing and using TheSupportiveMinds ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use this service.

2. Nature of the Service

TheSupportiveMinds provides two distinct categories of service:

• Teletherapy sessions: Live, scheduled video or phone sessions with HPCSA-registered mental health professionals. These sessions constitute a formal therapist-client relationship governed by the Health Professions Council of South Africa (HPCSA).
• Educational courses: Self-paced digital toolkits and blueprints created by HPCSA-registered professionals. These courses are educational resources only and do not constitute medical advice, psychological diagnosis, treatment, or a formal therapist-client relationship.

3. Educational Disclaimer

All courses and digital toolkits offered on TheSupportiveMinds are provided for educational purposes only. While our courses are authored by Cyrette Jacobs, a Registered Counselling Psychologist registered with the HPCSA, the course content:

• Does not constitute medical advice or psychological diagnosis
• Does not establish a formal therapist-client relationship
• Is not a substitute for individualised professional mental health treatment
• Should not be relied upon for crisis or emergency situations

Purchasing or completing a course does not make you a client of any therapist on this platform for the purposes of ongoing care. If you require individualised diagnosis or treatment, please book a teletherapy session or consult a registered mental health professional in your area.

4. HPCSA Compliance

All mental health professionals offering services through TheSupportiveMinds are registered with the Health Professions Council of South Africa (HPCSA) and practise in accordance with:

• The HPCSA Guidelines for Good Practice in the Healthcare Professions
• The Ethical Rules of Conduct for Practitioners Registered under the Health Professions Act, 1974 (Act 56 of 1974)
• The Protection of Personal Information Act (POPIA) regarding patient confidentiality

In accordance with HPCSA guidelines, TheSupportiveMinds and its practitioners do not use testimonials in advertising, do not guarantee specific treatment outcomes, and do not make unsubstantiated claims about the efficacy of any service or course.

The Platform's R70 per-session teletherapy Platform Fee is a fixed software infrastructure utilization charge and does not constitute fee-splitting, commission, or a share of clinical fees under HPCSA Ethical Rule 7. The Platform does not receive a percentage of any practitioner's clinical fee, does not pay or receive commission for patient referrals, and does not share in the clinical fees charged for professional services rendered.

5. Fees & Service Model

The following plans and products are available:

• Essential — R499/session: 1 deep dive virtual session plus weekly counselor review.
• Standard Plus — R999/session: 1 extended therapy session plus therapist messaging.
• Courses — from R199 once-off: Self-paced educational toolkits with lifetime access.
• The Supportive Minds Interactive Community — R229/month: Weekly live sprints, 24/7 peer support, and on-demand replay access.

Subscription plans may be cancelled at any time. Course purchases are once-off and grant lifetime access to the purchased toolkit.

6. Course Creator Platform (B2B SaaS)

TheSupportiveMinds operates a B2B SaaS infrastructure platform enabling registered healthcare professionals — including HPCSA-registered mental health professionals and SANC-registered nurses — to create, host, and sell public educational courses. The following terms apply specifically to Course Creators:

• Educational content only: Course Creators may only publish public health and mental health education content. Courses must not offer individualised clinical treatment, medical advice, private practice referrals, or establish a therapist-patient or nurse-patient relationship through course materials. All courses are educational resources and do not replace professional medical treatment, diagnosis, or care.
• Creator eligibility: Course Creators must be registered with either the Health Professions Council of South Africa (HPCSA) or the South African Nursing Council (SANC) and must maintain active registration throughout their use of the platform. Course Creators author content in their personal professional capacity.
• Nurse Course Creators: SANC-registered nurses may create and sell public health education courses on the platform. Nurse Course Creators are solely responsible for ensuring that their courses are strictly educational in nature and do not constitute medical advice, clinical treatment, or individualised nursing care. Nurses must not use courses to provide individualised medical guidance, replace clinical treatment, or establish nurse-patient relationships. Nurse Course Creators receive full platform access at no monthly subscription cost; only the standard per-course infrastructure fee applies.
• Zero Fees & Commission: All Course Creators — including HPCSA-registered professionals (Psychologists, Assistant Psychologists, Registered Counsellors, Social Workers, Occupational Therapists, Psychometrists), SANC-Registered Nurses, and Student Nurse / Peer Creators — receive full platform access at no monthly subscription cost and pay zero platform commission and zero per-course infrastructure fees. The Course Creator receives 100% of course sales revenue, less only standard external payment processing fees (Yoco).
• Subscription: All Course Creators receive full platform access at no monthly cost. There is no subscription fee, no per-course fee, and no commission. Courses remain accessible to enrolled students at all times.
• Content responsibility: Course Creators are solely responsible for the accuracy, quality, and regulatory compliance of their course content. TheSupportiveMinds acts as a hosting and payment infrastructure provider and does not endorse, verify, or guarantee the clinical or medical accuracy of individual course content.
• No testimonials or outcome guarantees: In accordance with professional guidelines, Course Creators must not use testimonials in course advertising, guarantee specific treatment outcomes, or make unsubstantiated claims about the efficacy of any course.
• Prohibited content: Course Creators must not use courses to solicit private clinical consultations, upsell individual therapy or medical sessions, or direct students to their private practice for clinical treatment. Courses are educational resources, not treatment vehicles.
• Content review & removal: TheSupportiveMinds reserves the right to review, flag, and remove any course that is found to be non-educational, that provides individualised medical or clinical advice, or that violates these Terms. The platform may suspend or terminate a Course Creator's access if their content is repeatedly flagged or found to breach the educational-only requirement. Course Creators acknowledge that the platform's determination of whether content is educational is final and binding.

7. Refund Policy

We stand behind our courses with a 7-day satisfaction guarantee. If you are not satisfied with a course purchase, email us within 7 days of purchase for a full refund. Subscription plans may be cancelled at any time; fees paid for the current billing period are non-refundable.

Refunds for teletherapy sessions are handled on a case-by-case basis. Please contact us to discuss any concerns.

8. Use License

Permission is granted to temporarily access the materials on TheSupportiveMinds for personal, non-commercial use only. Under this license you may not modify, copy, redistribute, or use the materials commercially.

9. Disclaimer of Warranties

The materials on TheSupportiveMinds are provided on an 'as is' basis without warranties of any kind, whether express or implied. TheSupportiveMinds does not warrant that the service will be uninterrupted, error-free, or that it will produce any specific result.

10. Limitations of Liability

In no event shall TheSupportiveMinds or its practitioners be liable for any damages arising out of the use or inability to use the materials on TheSupportiveMinds. The Service is not intended to replace professional medical or psychological care.

11. Medical Emergency

TheSupportiveMinds is not an emergency service. If you are experiencing a mental health crisis, contact your local emergency services or a crisis helpline immediately. South African Crisis Line: 0800 567 567. In a life-threatening emergency, call 10111.

12. Governing Law

These terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
